These Terms and Conditions ("Terms") govern your access to and use of the Profixa website at profixa.com and all related services, including PROFIXA AI CLARITY™ ("Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Nature of Services

Educational and Informational Only

Profixa provides financial education, consumer literacy support, and strategic guidance services for informational and educational purposes only. Nothing provided through our Services constitutes legal advice, legal representation, financial advice, investment advice, tax advice, accounting services, credit repair services, or any other licensed professional service.

Not a Credit Repair Organization

Profixa is not a credit repair organization as defined under the Credit Repair Organizations Act (CROA) or any applicable state law. We do not offer to improve, repair, or alter any consumer's credit record, credit history, or credit rating for compensation.

Not a Debt Settlement or Legal Service

Profixa is not a debt settlement company, debt management company, debt negotiation service, or law firm. We do not negotiate with creditors on behalf of consumers or provide legal representation.

2. No Guarantees of Outcomes

Individual Results Vary

Profixa does not guarantee any specific outcomes, results, improvements to credit scores, resolution of disputes, debt reduction, or any other financial or legal result from the use of our Services. Individual results will vary based on each consumer's unique circumstances.

Seek Licensed Professionals

Consumers are strongly encouraged to consult with licensed attorneys, certified public accountants, licensed financial advisors, mortgage professionals, or other qualified professionals for advice specific to their individual legal, tax, financial, or credit situations. Profixa's educational services are not a substitute for professional advice.

3. Payments and Refunds

Educational Service Fees

All payments for PROFIXA AI CLARITY™ review tiers are one-time fees for educational services. These are not subscriptions and do not renew automatically.

Refund Policy

Due to the nature of digital educational services, all sales are generally final. If you have a concern about a purchase, please contact us at [email protected] within 7 days of your purchase date and we will review your request on a case-by-case basis.

Payment Processing

Payments are processed through secure third-party payment processors. Profixa does not store your full payment card information on our servers.

4. User Responsibilities

Accurate Information

You agree to provide accurate, current, and complete information when using our Services, including the Community Uplift Intake form.

Permitted Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You may not use our Services in any way that could damage, disable, overburden, or impair our website or interfere with any other party's use of our Services.

Age Requirement

You must be at least 18 years of age to use our Services independently. Minors may use our Youth Financial Literacy programs only with parental or guardian consent and supervision.

5. Intellectual Property

All content on the Profixa website, including text, graphics, logos, images, and software, is the property of Profixa and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Profixa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of our Services.

Our total liability to you for any claims arising from your use of our Services shall not exceed the amount you paid to Profixa in the twelve (12) months preceding the claim.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Profixa is incorporated, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.

8. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of our Services after any changes constitutes your acceptance of the new Terms.
